Condominium and Homeowner Association Law: In this timely course offering, students will gain an understanding and working knowledge of the evolving and increasingly important law pertaining to condominiums, planned communities and other forms of common interest ownership communities in today's real estate marketplace. Topics will include the creation and development of the community association, association governance and dispute resolution, constitutional and public policy considerations, enforcement of restrictive covenants, collection of assessments, Fair Housing Act issues, liabilities of owners, associations and board members and emerging trends in the community association arena. The rights and obligations of developers, builders, associations, owners, buyers, sellers and municipalities will be addressed throughout the course, including the lawyer's role in representing such parties. Although the course specifically covers the law of condominium and homeowner associations, the course also emphasizes practical considerations and creative approaches in the handling of disputes that can benefit students interested in any field of law.
