Regulatory State
First Year Elective. This three-credit course introduces the institutions and procedures of the modern federal regulatory state. Although judge-made common law continues to play an important role in the U.S. legal system, many of the most important rules that govern our society are established through statutes that are interpreted and implemented by administrative agencies. This course explores the reasons behind the United States' turn to administrative government, the constitutional principles governing the design of the "administrative state," and the roles that Congress, agencies, and the courts play in the development and implementation of federal regulatory policy.
