Workers' Compensation Law

Students will study the essential aspects of workers' compensation laws, coverages, the various levels and varieties of benefits provided, and how claims are established and enforced. The Pennsylvania Act will be used as a model act for purposes of comparison. The class is taught from a very practical viewpoint, giving students the skills necessary to practice in this area. Anyone interested in complex tort law (personal injury litigation) or employment law should consider taking this course. Special emphasis will be placed on how these laws affect the rights of individuals to other remedies, such as the ability to sue in tort (third party case) or to apply for other benefits such as Social Security Disability. Class work will be complemented by guest-speakers from some of the top workers' compensation firms in Philadelphia. Towards the end of the semester, students will be divided (choosing to represent either Claimant or Employer) and given 2-3 weeks to complete the paper/assignment of submitting post-trial submissions (Proposed Findings of Fact and a Mediation Memo) from a real workers' compensation case which will be due the last day of class. Students will also participate in a 15 minute mock workers' compensation mediation on the last day of class. Exam Info: No Exam
