Trade Secret Law

Trade secret law is the most recent, and most explicitly business-centric, of the intellectual property doctrines, tracing its origins back to the Industrial Revolution. This course will explain, examine, and apply all of the core doctrinal areas of trade secrets, both under state common law, as reflected in the Uniform Trade Secrets Act, and under the recently enacted federal Defend Trade Secrets Act of 2016. The course will also examine topics that frequently go hand in hand with core trade secret law, such as patent law, employee and supplier non-compete agreements, idea misappropriation, inevitable disclosure and unfair competition.
