Civ & Crim Health Care Fraud

Each year, tens of billions of dollars are lost to health care provider fraud and abuse in the US. Fear of prosecution pervades the industry and shapes business decisions. Students in this course study the many laws that place health care providers at risk of criminal prosecution and civil penalties, including the False Claims Act, the Medicare/Medicaid Anti-Kickback Act, HIPAA, the Food, Drug and Cosmetic Act, antitrust law, securities law, the Stark Law, as well as numberous criminal statutes that are applicable to health care. Students explore civil, criminal and administrative remedies from the persspective of prosecutor, defense counsel, corporate counsel, corporate counsel, compliance counsel and regulator.
